1 Validity

These general terms and conditions (hereinafter: GTC) apply to all contracts concluded with you as a consumer via the online shop www.goldfooddekadenz.com. We do not recognize any regulations that deviate from these General Terms and Conditions unless they have been confirmed by us in writing.

2 order process

(1) Our offers on the Internet are non-binding.

(2) You order our goods by submitting all order data in full via our website. By confirming the purchase by clicking the "Order with obligation to pay" button, you make a binding offer to conclude a purchase contract by ordering the goods contained in the shopping cart. We only accept orders for normal household quantities via the online shop. If this is not the case, we will inform you accordingly. We will also inform you if the goods you have ordered are not in stock. There is no entitlement to acceptance. 

(3) After sending the order, you will receive an automatic confirmation of receipt by e-mail, which reflects the content of your order. This automatic confirmation of receipt does not constitute acceptance of the offer, but merely documents that we have received the order.

(4) The contract is only concluded upon receipt of the declaration of acceptance. This can be done by sending the shipping confirmation or by sending the goods.

(5) The purchase contract is concluded between you (customer) and us (seller), "Franz Bauer - GoldFoodDekadenz®". The prerequisite for the conclusion of the contract is that you are of legal age. With your order you confirm that you have reached the age of 18.

3 delivery

(1) We deliver to any desired address worldwide - excluding the United States of America and Canada. Packaging and shipping costs are at the expense of the customer. In the case of incorrect shipments due to incorrect address information, as well as unaccepted packages, we must pass on the costs to the customer. Please understand this. Deliveries within Germany are not made to German packing stations or German islands.

(2) Please check immediately upon receipt whether the delivery is undamaged and whether it corresponds to the ordered goods in terms of quality and quantity. Please have the deliverer acknowledge incorrect deliveries or damage and then contact us. The statutory warranty rights to which you are entitled are not affected by this

4 Prices and shipping costs, invoicing

(1) All prices quoted include the applicable statutory value-added tax.

(2) Deliveries are made within Germany and to the following countries:
EU member countries, United Kingdom, Norway, Switzerland, Hong Kong, Iceland, Israel, Japan, New Zealand, Singapore, South Africa, South Korea, Taiwan. Other countries on request.
(3) The shipment  Within Germany, the shipment is made by DHL package, shipping within Europe and worldwide via the DHL package service as a premium package. The dispatch takes place after receipt of payment within 7 working days.

Unless otherwise agreed, delivery is made from our warehouse to the delivery address specified by the customer. Check our website for product availability information. We expressly point out that all information on the availability, shipping or delivery of a product is only non-binding, expected information and approximate guide values. They do not represent binding and/or guaranteed shipping and/or delivery dates. Something else only applies if a binding shipping date is expressly stated in the shipping options for the respective product as part of the ordering process. 

(5) The purchase price is due when the order is sent. 

(6) Orders will only be shipped if payment is positive and complete.

5 vouchers

The following provisions apply to all "Franz Bauer - GoldFoodDekadenz®" vouchers.

(1) Vouchers are only valid for the period announced at the time of issue. An extension of the period is not possible.

(2) If the price of your order exceeds the credit on a voucher, you can make up the difference using the payment methods offered.

(3) Vouchers are neither paid out in cash nor do they bear interest.

(4) Lost, in particular stolen, vouchers will also not be reimbursed. "Franz Bauer - GoldFoodDekadenz®" assumes no liability for lost or stolen vouchers.

(5) "Franz Bauer - GoldFoodDekadenz®" reserves the right to refer to alternative payment methods in accordance with Section 4 (3), to refuse delivery and/or to block customer accounts if there is a justified suspicion of misuse in connection with the use of vouchers.

The following additional provisions apply to all vouchers, discount codes and other price reductions, except for paid (gift) vouchers:

(6) Vouchers are not transferable.

(7) Vouchers can be tied to a minimum order value. The value of the goods must at least correspond to the amount of the promotional voucher. It is therefore not possible to refund or credit any remaining credit that arises if the value of the purchase is less than the value of the voucher.

(8) Vouchers will not be refunded if you return the goods in whole or in part or if goods can only be partially delivered.

(9) The value of the voucher will be divided proportionally between the products you have ordered. In the event of a return, the amount due for the returned product will be forfeited in full, even if the value of the retained products is greater than the minimum order value.

(10) Vouchers can be limited to individual products. They cannot then be transferred to other products.

6 Retention of Title

The delivered goods remain our property until full payment.

7 Warranty (liability for defects)

(1) The colors of the products shown on the Internet may differ slightly from the original for various reasons (monitor settings, quality of the graphics card, etc.).

(2) If our products are defective, you are entitled to the statutory warranty rights. In the event of problems, bad and/or faulty deliveries, you can send an email to franz.bauer@goldfooddekadenz.com at any time with the relevant photos.

8 Liability

If we have to pay for damage in accordance with the statutory regulations and/or in accordance with these conditions, which was not caused by intent or gross negligence, our liability is limited to the following: Liability only exists in the event of a breach of essential contractual obligations and is always limited to the Conclusion of the contract foreseeable typical damage limited. This limitation does not apply to injury to life, limb or health. Our no-fault liability under the Product Liability Act, in the event of fraudulent concealment of a defect or the assumption of the procurement risk or an independent guarantee remains unaffected.

9 Right of revocation and instructions on revocation

(1) Right of withdrawal for consumers
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

(2) Right of cancellation and cancellation policy

You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

by means of a clear statement (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory. We will immediately (e.g. by e-mail) send you confirmation of receipt of such a revocation.
To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

(4) Consequences of revocation
(4.1) If you withdraw from this contract, we will owe you all payments we have received from you, including delivery costs (except for additional costs resulting from your choosing a different type of delivery than that offered by us, have chosen cheap standard delivery) immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.
(4.2) We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
(4.3) You must return or hand over the goods to us immediately and in any event no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
(4.4) You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

(5) Exclusion of the right of withdrawal
The right of withdrawal does not apply to contracts
− for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,
− for the delivery of goods that can spoil quickly or whose use-by date would soon be exceeded,
− for the delivery of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed or damaged after delivery.

10 Online Dispute Resolution

Online dispute resolution in accordance with Art. 14 Para. 1 ODR-VO: The European Commission provides a platform for online dispute resolution (OS), which you can find at http://ec.europa.eu/consumers/odr/.

11 Law, Place of Jurisdiction

The law of the Federal Republic of Germany applies to contracts between the provider and the customer, excluding the UN sales law. In the case of orders from consumers from abroad, mandatory regulations or the protection granted by judicial law in the respective country of residence remain in place and apply accordingly.

 

12 Partial Invalidity

Should one or more provisions be or become invalid, this shall not affect the validity of the remaining provisions.
